1. About the Website 

1.1 Welcome to www.glowasyouare.com.au (Website). The Website provides you with an opportunity to browse, learn about, and book energy-healing and spiritual services offered by Glow As You Are (Services). Access to the Website also provides you with the ability to join consultations, view resources and engage with informational content (Booking Services). 

1.2 The Website is operated by Glow As You Are (ABN 82 308 956 808). Please read these terms and conditions (Terms) carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of Services, immediately. 

1.3 Glow As You Are reserves the right to review and change any of the Terms by updating this page at its sole discretion. When Glow As You Are updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication. 

2. Acceptance of the Terms

2.1 You accept the Terms by remaining on the Website or by clicking to accept or agree to the Terms option if this is made available to you through the Website or booking platform, submit a booking, or complete the Client Intake Form. 

2.2 For the purposes of these Terms, “Client” means any individual who accesses the Website, books a session, completes the Client Intake Form or otherwise uses the Services.

2.3 These Terms are provided in English. By booking a session, you acknowledge and agree that the English version of these Terms governs your use of the Services, even if translated for convenience. 

3. Registration to use the Purchase Services

3.1 To access the Booking Services or to participate in an energy healing session, you may be required to provide personal information, including but not limited to:

• full name

• contact details

• date of birth

• preferred communication method

• emergency contact information

• details about prior energy healing experience

• goals or intentions for your session

• information regarding any physical, mental, emotional or spiritual conditions you wish to focus on during the session

3.2 You acknowledge that some of this information may constitute sensitive information, and by providing such information voluntarily (including through the Client Intake Form), you consent to Glow As You Are collecting and using that information for the purposes of providing the Services.

3.3 You warrant that any information you give to Glow As You Are is correct and up to date. 

3.4 You may not use the Services if you are under the legal age to form a binding contract or are otherwise prohibited from accessing such services under applicable law. Services are not available to individuals under 18 years of age without written consent from a parent or guardian.

4. Your Obligations as a Client  

4.1 As a Client, you agree to comply with the following: You will use the Website and Services only for purposes that are permitted below: 

(a) Only for lawful purposes and in accordance with these Terms.

(b) Ensure the confidentiality and security of the devices and login information you use to access the Website or online sessions.

(c) Notify Glow As You Are immediately of any unauthorised access to your information or of any security breach.

(d) Not use the Website or Services for fraudulent, harmful, commercial or unlawful purposes.

(e) Not engage in automated use of booking systems or interfere with the Website’s functioning.

(f) Ensure that any information you provide in the Client Intake Form is complete and accurate.

(g) Disclose any relevant physical, mental, emotional or spiritual conditions that may assist in tailoring your session. You acknowledge that Glow As You Are does not provide medical care and reliance on the information you provide does not constitute clinical assessment or treatment.

(h) Understand that the Services are not a substitute for medical or psychological care. Consent to Glow As You Are contacting your nominated emergency contact if a serious concern arises regarding your wellbeing during a session.

4.2. By submitting the Client Intake Form, you confirm you have read and agree to these Terms and the Privacy Policy.

5. Purchase of Services and Payments

5.1 Clients may book Services online through the Website or associated platforms. Services must be paid for at the time of booking unless otherwise stated. 

5.2 Accepted payment methods include PayPal, Afterpay, Klarna, Google Pay, Stripe and bank transfer. 

5.3 Your booking is confirmed only once payment has been processed.

5.4 Clients are responsible for ensuring they attend sessions at the correct time for their time zone. Refunds will not be issued for missed sessions caused by time-zone miscalculations.

6. Cancellation, Rescheduling and Refund Policy 

6.1 Client Cancellations

(a)Cancellations made more than 48 hours before the scheduled appointment time will receive a full refund.

(b) Cancellations made within 48 hours of the scheduled appointment time will receive an 80% refund.

(c) No-show appointments are non-refundable. 

6.2 Rescheduling

(a) Clients may request to reschedule an appointment more than 48 hours before the scheduled appointment time.

(b) Rescheduling requests made within 48 hours of the appointment may not be accepted. In the event that we cannot facilitate a reschedule, cancellation rules apply.

6.3 Late Arrivals

(a) If a Client arrives late to a session, the session will conclude at the originally scheduled end time. 

(b) No refund or credit will be issued for any portion of the session missed due to late arrival.

6.4 Package Bookings 

(a) Rescheduling of package sessions must be requested more than 48 hours in advance.

(b) No rescheduling will be accepted for package sessions within 48 hours of the appointment.

(c) A no-show will result in one session being deducted from the package with no refund.

(d) If a package session is cancelled more than 48 hours in advance, the Client may receive a pro-rata refund for unused sessions, and no session will be deducted.

(e) If a package session is cancelled within 48 hours and the client requests a refund, the cancelled session will be refunded at 80 percent and any remaining unused sessions will be refunded in full on a pro-rata basis.

(f) If a package session is cancelled within 48 hours and no refund is requested, one session will be deducted from the package and the remaining sessions will remain available for use.

7. Delivery of Online Services 

All sessions are delivered online through platforms such as Zoom or Google Meet. Glow As You Are is not responsible for disruptions caused by internet instability, device malfunction, software issues or other technical problems outside its control.

Where technical issues prevent the delivery of the Service and the issue is caused by the practitioner’s system, a rescheduled session will be offered at no additional charge. Where resupply is not possible or reasonable, you may be entitled to a refund in accordance with your rights under the Australian Consumer Law. 

If technical issues arise on the Client’s end that prevent the session from proceeding, Glow As You Are does not guarantee that a refund or reschedule will be provided, and any such request will be considered at Glow As You Are’s discretion.

8. Copyright and Intellectual Property 

8.1 The Website, the Services and all related materials, content and digital products of Glow As You Are are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and international treaties. Unless otherwise indicated, all rights (including copyright) in the Services and in the compilation of the Website (including but not limited to text, graphics, logos, button icons, videos, audio clips, Website code, scripts, design elements and interactive features) are owned or controlled by Glow As You Are or its contributors.

8.2 All trademarks, service marks and trade names appearing on the Website or within the Services are owned, registered and/or licensed by Glow As You Are.

8.3 Nothing you do on or in connection with the Website transfers to you:

(a) any business name, trading name, domain name, trademark, industrial design, patent or copyright;

(b) any right to use or commercially exploit Glow As You Are’s intellectual property; or

(c) any system, process or material protected by intellectual property law.

8.4 You may not, without prior written permission:

(a) broadcast, republish, copy, reproduce, upload, post, transmit or distribute any content;

(b) publicly show or play any content;

(c) modify, adapt, translate or create derivative works;

(d) use any content for commercial, professional, educational or training purposes; 

(e) upload or share content to third-party platforms or social media; or

(f) misrepresent affiliation or infringe Glow As You Are’s intellectual property rights.

8.5 All content provided during or after sessions is for private personal use only and cannot be shared or reproduced.

8.6 Clients are not permitted to record sessions without written consent. Any authorised recordings remain the property of Glow As You Are.

8.7 Third-party material remains the property of its respective owners. Permission must be obtained directly from those owners for any use.

9. Privacy 

9.1 Glow As You Are collects personal and sensitive information through: 

(a) the Client Intake Form (digital, Google Form, PDF or email);

(b) Acuity scheduling;

(c) Google Workspace (email, Google Drive, cloud storage, virtual sessions); 

(d) PayPal and Stripe payment platforms and; 

(e) Social media channels such as YouTube, Facebook, Instagram or WhatsApp, to the extent you choose to interact with us through those platforms. 

9.2 Information collected includes identification details, contact information, emergency details, session notes, intuitive impressions, and any voluntarily disclosed emotional, physical or spiritual information.

9.3 Client information is securely stored on an encrypted external hard drive. Session notes and intuitive impressions recorded by the practitioner form part of your client record and are handled in accordance with the Privacy Policy.

9.4 Some third-party providers (such as Stripe, Acuity, PayPal and Google) store data overseas. By using the Website and Services, you consent to such overseas storage.

9.5 All personal information is kept strictly confidential and used only for the purposes of providing the Services, except where disclosure is required by law or necessary for safety.

10. General Disclaimer 

Use of the Website and Services is at your own risk. All content is provided “as is” without warranties. Glow As You Are does not guarantee uninterrupted access, accuracy, or suitability of information, nor does it guarantee any outcome from the Services.

11. Disclaimer – Nature of Services

11.1 Glow As You Are provides energy-healing and spiritual services only. These services are intended to support your energetic, emotional and spiritual wellbeing.

11.2 Practitioners are not medical doctors, psychologists, psychiatrists or healthcare professionals.
These Services:

• do not diagnose medical or psychological conditions

• do not claim to cure or treat illness

• do not replace professional medical, psychological or therapeutic care

If you have medical concerns, you must consult a qualified healthcare professional.

11.3 Some Clients may experience natural energetic responses following a session, including emotional release, vivid dreams, tiredness, thirst or temporary emotional sensitivity. These are normal energetic reactions. If symptoms persist, you must seek medical or psychological support. Providing information in the Client Intake Form assists with tailoring your session but does not create a treatment plan. No outcomes or specific results are guaranteed.

12. Limitation of Liability

12.1 To the fullest extent permitted by law, Glow As You Are disclaims all liability for any loss, damage, injury, claim or expense (whether direct, indirect, incidental, special, consequential or exemplary) arising out of or in connection with your use of the Website or the Services, including but not limited to:

12.1.1 reliance on any energy-healing, intuitive, psychic, spiritual or energetic guidance provided during or after your session;

12.1.2 emotional, physical or energetic responses that arise during or after a session, including emotional release, fatigue, sensitivity, vivid dreams, restlessness or temporary discomfort;

12.1.3 your failure to seek appropriate medical, psychological or other professional advice when required;

12.1.4 misunderstandings arising from incomplete, inaccurate or omitted information in your Client Intake Form or any other information you provide;

12.1.5 technical issues that prevent or disrupt online sessions, including internet connection failures, device malfunctions, software issues, platform outages or other circumstances outside Glow As You Are’s control;

12.1.6 any decisions, lifestyle changes, actions or inactions you take following a session;

12.1.7 third-party actions, omissions or systems, including third-party platforms used for bookings, communications, payments and virtual sessions;

12.1.8 unauthorised access to your personal information due to events beyond reasonable control, such as cyberattacks affecting external service providers.

12.2 You acknowledge that spiritual and energy-healing services are inherently subjective, individual and experiential. Glow As You Are makes no guarantee, representation or warranty as to:

12.2.1 the accuracy, completeness or usefulness of intuitive or energetic impressions;

12.2.2 the outcome, effectiveness or results of any session;

12.2.3 the duration or nature of energetic integration following a session;

12.2.4 the achievement of any goals, intentions or desired states discussed before or during the Services.

12.3 Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law (ACL), negligence and criminal conduct, that cannot lawfully be excluded. Where Glow As You Are’s liability cannot be excluded under the ACL, it is limited (to the maximum extent permitted by law) to one of the following, at Glow As You Are’s sole discretion:

12.3.1 the resupply of the Services; or

12.3.2 the cost of having the Services supplied again.

12.4 Glow As You Are is not liable for any loss of profit, loss of business opportunity, loss of data, interruption to business, damage to goodwill, emotional distress, or any other intangible or non-economic loss arising from or relating to the Services or Website.

12.5 By booking and participating in sessions, you acknowledge and agree that:

12.5.1 you are solely responsible for your own physical, emotional, psychological and spiritual wellbeing;

12.5.2 the Services are complementary and non-medical in nature;

12.5.3 the practitioner’s insights are interpretations, not factual predictions or guarantees;

12.5.4 your choices and actions remain entirely your own responsibility.

12.6 You agree that Glow As You Are will not be held responsible for any consequences arising from your personal interpretation, application or misunderstanding of information shared during a session.

13. Indemnity 

13.1 You agree to indemnify Glow As You Are for any loss, liability, costs or damages arising out of:

13.1.1 your breach of these Terms; 

13.1.2 inaccurate, incomplete or misleading information you provide; 

13.1.3 your misuse of the Website or Services; 

13.1.4 reliance on any spiritual or energetic guidance beyond the scope of the Services. 

14. Governing Law 

The Terms are governed by the laws of New South Wales, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of New South Wales Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns. 

15. Severance 

If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.
